New York workers' compensation provides wage-replacement benefits (typically two-thirds of your average weekly wage, subject to a cap), full medical care for the injury, prescription coverage, vocational rehabilitation, schedule loss-of-use awards for permanent impairment, and death benefits for surviving family. Workers' comp is a no-fault system — you do not need to prove your employer was negligent.
You must generally choose a provider authorized by the New York Workers' Compensation Board, unless your employer has a Preferred Provider Organization in place during the first 30 days. A denial or a controverted claim is not the end. The case proceeds to a hearing before a Workers' Compensation Law Judge where medical records, witness testimony, and expert reports can establish that the injury arose out of and in the course of employment. Many denied claims are won at the hearing or on review.
Almost never. Workers' comp is generally the exclusive remedy against your direct employer. However, you can — and often should — file a third-party lawsuit against another negligent party (a property owner, a general contractor, a vehicle driver, a product manufacturer) for full damages including pain and suffering. We evaluate every comp case for a parallel third-party claim.

Most denied claims involve disputes about whether the injury is work-related, the extent of disability, or the average weekly wage.
