  • What employment claims do you handle?

  • Can my employer fire me for filing a complaint or hiring a lawyer?

    No. Both New York and federal law prohibit retaliation against employees who report discrimination, harassment, wage violations, or unsafe conditions, or who participate in an investigation or lawsuit.   • Am I entitled to unpaid overtime?

    Most non-exempt employees in New York are entitled to time-and-a-half for hours worked over 40 in a workweek. Many workers are mislabeled as "exempt," paid a salary, or improperly classified as independent contractors to avoid paying overtime. Title alone does not decide your status — the duties test does.

  • What counts as workplace discrimination or harassment in New York?

    New York's State and City Human Rights Laws are among the most protective in the country, covering discrimination based on race, sex, gender identity, sexual orientation, age, disability, religion, national origin, and many other categories. The City law's standard for hostile work environment is especially worker-friendly, and reaches conduct that would not be actionable under federal law.

  • How long do I have to file an employment claim?

    Deadlines vary by claim. Federal discrimination claims under Title VII generally require an EEOC charge within 300 days. New York State and City Human Rights Law claims can be filed in court within three years. Wage claims typically have a six-year statute of limitations under New York Labor Law.
